Bling Face Painting & Entertainment Terms & Conditions

Effective for all bookings.

  1. Who We Are & How the Contract Works
  • Bling Face Painting (“we” or “us”) acts as an Entertainment company and an  agency—sometimes we don’t directly perform services but arrange them via professional entertainers (“Artistes”) like face painters, or balloon artists.
  • A booking can be made verbally, electronically, or in writing. Once made, it becomes a legally binding contract between you (“Client”) and the Bling Face Painting managing the agreement.
  • By booking, you confirm that you have legal authority to enter into this contract.
  1. Use of Your Information
  • We may share your details with the assigned Artiste to fulfill your booking.
  • By submitting your contact details on our website, you give permission for us to contact you.
  1. Booking Confirmation
  • Your booking is confirmed once both you and the Artiste accept it—no signature is needed.
  • Bling Face Painting will act as the negotiator between both parties for the period up to and including the date of the event and 24 months after the event.
  1. Payments & Deposits
  • A non-refundable deposit of 50% is required to confirm your booking.
  • Full payment is due 48 hours before the event, unless agreed otherwise.
  • Failure to pay the deposit within the required time frame may result in the booking being canceled at the discretion of Bling Face Painting.
  • Accepted payment methods will be detailed in your invoice.
  1. Photography & Video Use
  • Artistes will always ask permission before taking photos and videos.
  • Where permission has been granted images and recordings may be used on websites, social media or promotional advertisements.
  • No payment is given for this usage and clients can request specific images be removed from public use at any time.
  1. Backup Plan (Contingency)
  • If the scheduled Artiste can’t attend due to illness, weather, or emergency, we’ll try to find a suitable replacement.
  • If none is available, we’ll refund you any payment made by the client.
  •  We’re not responsible for other costs you may incur.
  1. Changes to the Booking
  • Changes to your booking (e.g., time, location, services) must be agreed with us at least 3 business days before the event.
  • Only one date change is allowed (such as postponement), and it must be within 90 days of the original event date. Beyond that, cancellation terms apply.
  1. Right to Refuse Service
  • We may refuse service to anyone, for any reason, at any time.
  1. Abuse Policy
  • Should the Artiste, at any time, experience or is threatened by any form of abuse in any manner from the client or any individual at the event, the contract will terminate immediately, and all fees for the services shall be paid by the client in full.
  1. Payment Policies
  • Payments must be made to Bling Face Painting (not directly to Artistes).
  • Artistes will be paid after we receive their invoice.
  • Payment Schedule:
    • Within 4 weeks of event: Full payment is due immediately.
    • More than 4 weeks in advance:
      • Under $400: 50% non-refundable retainer, balance due before the event.
      • $400 or more: 50% non-refundable retainer, balance due before the event.
  • All retainers are non-refundable.
  • Late payments may incur a 1.5% monthly interest and may be sent to collections.
  1. Cancellations

By Client:

  • More than 4 weeks before event: Refund minus the non-refundable retainer.
  • 4 weeks or less: No refund. Full payment is due.
  • Cancellation must be sent in writing.

By Artiste:

  • If the Artiste cancels, we’ll attempt to find a suitable replacement.
  • If a replacement isn’t available, we’ll refund your payment.
  • If a lower-cost replacement is found, we’ll refund the difference.
  1. Postponements
  • No date changes are allowed within 2 weeks of the event.
  • Reschedules must be:
    • Requested at least 2 weeks in advance
    • Within 90 days of the original date
    • Based on availability
    • Only allowed to reschedule once

Rescheduling Due to Weather or Unforeseen Causes

  • In the event of inclement weather or unforeseen circumstances Bling Face Painting will work with the client to reschedule the event, subject to availability. If rescheduling is required, the original 50% booking fee will be retained and is not refundable under any circumstances. This policy remains in effect even for same-day cancellations, as our Artists are committed and compensated for their time. If a cancellation Occurs within 48 hours of the scheduled event, the client may be responsible for additional costs if artists or vendors have already been dispatched or incurred expenses. We will make every reasonable effort to reschedule postponed events (subject to availability), and in such cases the booking fee may be applied towards the new date at our discretion.
  1. Late Payments
  • If you don’t pay on time, your booking may be canceled.
  • Late payments are subject to 1.5% monthly interest.
  • Accounts overdue may be sent to collections.
  1. Your Responsibility for Booking Info
  • You must ensure all Booking details are accurate. Let us know ASAP if anything is incorrect.
  • Changes to the Booking details are not included in your fees and may incur extra costs.
  1. Venue Suitability
  • You’re responsible for ensuring the event venue:
    • Allows for the services to take place.
    • Has enough space for the booked services.
    • Allows access for setup.
    • Meets health and safety standards.
  • If the venue is unsuitable, we may cancel the booking without refund.
  • Client is responsible to cover any parking costs for the Artist if free parking isn’t available.
  1. Complaints
  • If you believe the Artist didn’t meet expectations, submit a written complaint within 30 days of the event.
  • Fees must still be paid on time, even while the issue is reviewed.
  • Bling Face Painting will mediate, but cannot guarantee resolution.

 

  1. Day-Of Changes
  • Any unavoidable changes on the day of the event should be discussed with Bling Face Painting when possible.
  • If not, you and the Artist can agree directly, but the Terms still apply.
  1. Event Delays & Overtime
  • In the event of delays, changes or alterations to the schedule that prevent the Artist from completing their full performance time within the scheduled outlined time in the contract, no refunds apply.
  • If the event runs late, and the artist is requested to stay beyond the contracted finish time, the artist .
  • The Artist can decline overtime without penalty.
  1. Extended Time Fees
  • If the Artist agrees to extend their performance time beyond the agreed-upon contract, the standard hourly rate will automatically apply to all additionally time worked
  • Extended time is subject to the Artists availability and is not guaranteed.
  1. Re-Booking the Artist
  • The client agrees to book the same Artist only through Bling Face Painting and not with the Artist directly, for 24 months after your contracted event.
  • Artists must not give out personal contact details or promotional materials. Doing so may result in termination of their contract.

 

  1. Artist’s Performance Standards
  • Artists will:
    • Deliver a high-quality performance, as advertised.
    • Bring and maintain all required equipment unless otherwise agreed.
    • Be professional and respectful.
    • Refrain from alcohol, drugs, or inappropriate conduct at events.
    • Be responsible for their taxes, insurance, and necessary certifications.
  • Mascot performers will not carry cakes.
  • Artists must have at least $2,000,000 Public Liability Insurance.
  1. Equipment Use & Damage
  • Artist’s equipment is not to be used by others.
  • The Client is responsible for the cost of any damage caused by guests to costumes or equipment.
  1. Supervision of Children
  • Bling Face Painting artists are not responsible for supervising Children while rendering services. It is the client’s responsibility to ensure that all children are supervised by a responsible adult throughout the event.

 

  1. Legal Jurisdiction
  • These Terms are governed by Ontario, Canada law.
  • Disputes must be handled in Ontario courts after reasonable attempts to resolve them with us directly.
  1. General Provisions
  • We may update these Terms at any time.
  • We may issue warnings, suspend services, or take legal action if these Terms are breached.
  • You may not transfer your rights under these Terms to another party.
  • If any part of the Terms is unenforceable, the rest remains valid.
